Claim for damages launched by Cooper Tire & Rubber Company Europe Limited and other 25 claimantsUnipetrol, a.s.("Unipetrol") has been served with a claim for damages launched by Cooper Tire & Rubber Company Europe Limited and other 25 claimants against Shell Chemicals U.K. Limited and other 22 defendants including Unipetrol. The claim for damages has been filed with the High Court of Justice, Queen´s Bench Division, Commercial Court, on February 22, 2008. The amount claimed is to be assessed.
The claimants who are manufacturers of tyres and other Butadiene Rubber ("BR") and Emulsion Styrene Butadiene Rubber ("ESBR") products ask for damages together with interest to compensate for their loss suffered as a result of an alleged cartel operated by companies belonging to the Shell, Bayer, Dow, Unipetrol, Trade-Stomil and Eni groups between, at least, 1996 and 2002.
This cartel has been object of a decision of the Commission of the European Communities ("the Commission") of November, 2006. In this decision the Commission established existence of the alleged cartel and imposed fines accordingly. Unipetrol and its then subsidiary Kaučuk were jointly imposed a fine of EUR 17, 5 million. Both companies appealed to the Court of First Instance of the European Communities and this action is currently pending.
