With reference to our contractual relationship, we regret to inform you that, as a result of the escalation of the international geopolitical situation, we are currently facing disruptions in the supply chain and significant restrictions on the supply of raw materials that our company uses in its production processes. These disruptions are occurring entirely independently and beyond the control of our company. Although we are taking all available measures to mitigate the negative impacts of these disruptions in the supply of raw materials, we are compelled to inform you that, as a result of this extraordinary situation, oil processing at our refinery in Litvínov, as well as production at the ethylene unit and the polymerization units, is seriously threatened.
This event constitutes, among other things, an extraordinary, unforeseeable, and insurmountable obstacle arising independently of the will of ORLEN Unipetrol RPA s.r.o. and beyond its control, i.e., a force majeure event. This obstacle—the force majeure event—continues to persist.
The occurrence and duration of the aforementioned obstacle—the force majeure event on the part of ORLEN Unipetrol RPA s.r.o.—prevents ORLEN Unipetrol RPA s.r.o. from properly fulfilling its obligations arising from contractual relationships with its business partners.
The occurrence of this obstacle—a force majeure event—excludes the liability of ORLEN Unipetrol RPA s.r.o. and releases ORLEN Unipetrol RPA s.r.o. from its obligations arising from or in connection with contractual relationships with its business partners, including, among other things, the obligation to compensate for damage or other harm, or obligations or liabilities under any other contractual provisions providing for remedies.
We are working diligently to mitigate the consequences of force majeure and to uphold our contractual obligations to the greatest extent possible.
